Plaintiff Kevin Yan Luis claims that Yankee Candle violates the Americans with Disabilities Act (ADA) by denying blind and visually impaired people equal access to its goods and services.

Yan Luis, who is legally blind, says the Chesapeake Bay Candle section of the Yankee Candle website contains thousands of access barriers that make navigation “difficult, if not impossible” for people who are blind or visually impaired.

According to Yan Luis, barriers to access make it “impossible” to complete a transaction on the website, which excludes blind and visually impaired people from “full and equal participation in the growing internet economy that is increasingly a fundamental element of the common good”. the market and daily life.

Yan Luis wants to represent a national class and a New York underclass of legally blind individuals who have been denied access to the goods and services offered in the Chesapeake Bay Candle section of the Yankee Candle website.

Plaintiff seeks a jury trial and seeks injunctive and declaratory relief as well as compensatory and statutory damages for himself and all class members.

A separate class action lawsuit was filed against Yankee Candle in 2019 following allegations that the company sold the personal information of its customers to third-party data mining companies.
